SHERIFF’S MOTOR VEHICLE AUCTION ELIGIBILITY TO BID/PURCHASE A VEHICLE

Can I buy back my own vehicle? Purchasers are prohibited from buying back their own vehicle(s).

2. How old do I have to be to buy at an auction? Bidders/Purchasers must be at least 18 years old.
3. Can I pay with a credit card? Can I make a down payment? Bidders must be prepared to pay for any vehicle they purchase as soon as they make the winning (highest) bid. Payments must be made in cash. Anyone not prepared to pay immediately should not bid.
CONDITION OF VEHICLES
4. Do the vehicles have warranties? Finance and the Sheriff make no warranty, expressed or implied, as to the year of any vehicle or any vehicle's quality or state of repair.
5. If there are problems with the vehicle will the City make reparations? Purchasers have no legal recourse against the City. This includes the Department of Finance, the Sheriff, or the auctioneer of the vehicle purchased.
6. If the vehicle is a lemon can I renegotiate the price? The price of a vehicle will not be changed after sale due to the vehicle's condition.
LIENS ON VEHICLES
7. Are any vehicles sold with liens on them? Yes, in some cases. Purchasers buy the right, title, and interest to a vehicle, subject to any and all recorded liens. A vehicle subject to a lien remains subject to the lien after sale. Any vehicle with a lien may be subject to repossession by the lien holder. The Sheriff is not responsible for notifying bidders about liens on vehicles.
8. If the vehicle has parking tickets from the previous owner, am I responsible? Purchasers are not responsible for any outstanding parking tickets that were issued to the former registered owner of the vehicle.

Stopping a Tow in Progress
If you come across your car being put on a tow truck, you can stop the tow if you call 1-877-207-2134 immediately to pay your judgment debt and fees over the phone. You will not be charged the full tow fee but must pay a tow dispatch fee of $67.50.
Note: If your vehicle was booted before it was towed, you must first call 1-877-207-2134. You must pay all of your outstanding judgment debt. You will then receive information for getting your vehicle back. For additional assistance locating a towed vehicle:

Vehicle Auctions,
The vehicle’s owner must pay all tickets that are in judgment and penalties and interest to redeem the vehicle.

Towed vehicles are sold at auction if they are not redeemed after ten business days from the  date.
Proceeds from the auction, after expenses, are used to pay the judgment debt. Expenses may include fees for execution ($80), poundage, storage, booting, towing, advertisement costs, auctioneer and plate removal. All vehicles are sold "as is” and the purchaser must pick them up where they are located.

​​Payment Plans
A payment plan (also known as an installment agreement or installment plan) is an agreement between you and the department under which you agree to pay the amount you owe over time instead of paying the full amount all at once. A payment plan for parking tickets will also allow you to avoid having enforcement actions such as having your vehicle booted or towed without you having to pay off your  entire debt immediately.Payment Plan vs. paying your bill all at once A payment plan allows you to make a series of smaller payments instead of making one large payment, but it increases the total amount you will pay. This is because interest will continue to be added to your balance until the amount you owe is completely paid off.  For example, if you owe $1,000 and you choose a 2-year payment plan with 9% interest, you will end up paying a total of more than $1,100.
Entering into a payment plan for parking tickets will not enable you to obtain a Satisfaction of Judgment, Registration Clearance or Vehicle Release. In order to this, you must pay off your entire judgment debt.
Parking Ticket Payment Plan Requirements
You must be the registered owner or the owner’s court-appointed agent.
You must have at least 40 days left in the current registration. If approved, the plan will last only as long as the current registration.
Your vehicle has to have had proper insurance for more than 30 days.
You must owe more than $350 in parking and/or camera violation judgments.
Hearings on outstanding judgments must be completed.
Any current or defaulted Payment Plans must be paid in full.

Application Process
Fill out the Payment Plan Request Form and if you owe more than $10,000 in judgment debt, you also need to fill out a Parking Credit Application. Bring your completed form(s) to any Finance Business Center to enter into a payment agreement.

Removing the Boot from Your Vehicle
To get the boot off, call the toll-free phone number on the boot notice (877-207-2134) to pay all of your outstanding judgment debt, plus the additional fees listed below. You can pay over the phone with your debit/credit card or an electronic check. We also accept cash, money orders or cashier's checks at our Business Centers. After you pay what you owe, you will receive a release code immediately. When you enter the code, the boot will unlock and you can remove it. You need to return the boot to a return location near you within 24 hours to avoid a late fee of $25.00 per day. Note: If your car is booted or is at risk of being booted DO NOT PAY ONLINE. If your car is at risk of being booted and you choose to pay online then your vehicle may be booted or towed before your payment is processed. You will be responsible for all booting or towing fees.

Fees
There is a $159 fee for the boot and a $80 Sheriff’s execution fee as well as a poundage fee (5% of all fines including penalties and interest). If you do not pay the parking ticket or camera violation judgment debt and related fees within two business days of being booted, then your vehicle may be towed. Vehicle Auction Instructions.

 Bidding Vehicles will be bid on using their assigned lot number. 

Be sure you know the lot number of the vehicle(s) you want to bid on.
Vehicles are sold to the highest bidder. Each sale is final once the highest bid is accepted.
If there is a dispute about the highest bid between two or more bidders, the bidding process

will begin again.
The Department of Finance and/or the Sheriff (or their representative) may refuse any bid

and cancel the sale at any time.
After You Have Purchased A Vehicle at Auction You must pay with cash in full, including sales tax, as soon as the sale is final. We will waive sales tax if you present a resale certificate. In many cases, you may need to tow the auctioned vehicles from the yard. Vehicle keys are not available.
You must remove the vehicle from the tow yard by 5: 00 pm on the day of the auction or you will be charged a storage fee of $20 per day. If you do not take the vehicle within 96 hours after 5:00 pm of the auction date, it will be considered abandoned and will be removed. Once you remove a vehicle from the tow yard, you cannot park it on the street or drive it unless the owner has proper registration and license plates. This is required by New York State Law.
You must take the Certificate of Sale to the Department of Motor Vehicles to get a title issued in your name. We only issue one certificate of sale per owner – no exceptions.  We cannot issue duplicates for second copies or replacements of the original. 

The Department of Motor Vehicles may consider the vehicle as salvage. This means the vehicle may have to be examined

before a new title and/or registration is issued.
The tow yard may charge a tow fee to remove a purchased vehicle from the yard.
